Terms and Conditions for the Provision of Healthcare and Related Services

1. Introductory Provisions

1.1 These Terms and Conditions govern the rights and obligations between providers of rehabilitation services and clients (hereinafter referred to as the “customer”).

1.2 The service providers are Jiří Hájek, M.A., ID No.: 22122745, and Zdislava Tučková, M.A., ID No.: 22122664, Bc. Martin Vávra, ID No.: 22337920, all three with the business address: Pekařská 635/6, 158 00 Prague 5 – Jinonice (hereinafter referred to as the “Provider”).

2. Services Provided

2.1 The Provider offers individual physical therapy, individual and group exercise classes, personal training, and massage (hereinafter referred to as the “Services”).

3. Service Reservations and Deposits for Services Provided

3.1 Services are provided based on a prior reservation made by phone, email, or in person, or via the reservation form Rehatab, see Section 12 of these Terms and Conditions (contact information).

4. Price and Payment Terms

4.1 The prices for the services provided are listed on the providers’ websites or in price list available at the facility.

4.2 The Provider reserves the right to change the price list without prior notice. The Provider may not change the prices of services that have already been ordered. The new price list for the services provided will always be published on the Provider’s website and in the price list available at the business premises.

4.3 Payment for services is due immediately upon the provision of each service. Unless otherwise agreed

4.4 Payment can be made in cash, by bank transfer, or via QR code at the store.

5. Cancellation of Reservations and Cancellation Policy

5.1 The customer is required to arrive at the business location at the agreed time or to cancel or change the reservation no later than 24 hours before the scheduled time. This can be done either through the reservation system or by contacting the parties listed in Section 12 of these Terms and Conditions.

5.2 The Provider reserves the right to cancel the appointment. If the Provider needs to cancel the reservation, the Customer will be offered an alternative date.

5.3 In the event of a cancellation or rescheduling less than 24 hours before the scheduled date, the Provider reserves the right to charge a cancellation fee equal to 50% of the price of the ordered service.

5.4 If the Customer fails to show up for the booked service without prior notice, a cancellation fee equal to 100% of the price of the booked service will be charged.

6. Service Liability Guarantee

6.1 The Provider is required to provide services with professional care and in accordance with applicable laws and regulations, including laws and regulations governing the provision of health care services.

6.2 If the services are not provided in accordance with the contract and these Terms and Conditions, the customer has the right to file a complaint in accordance with Section 7 of these Terms and Conditions.

6.3 The Provider has taken out health care provider liability insurance in accordance with applicable laws.

6.4 The customer is required to notify the provider of any deficiencies in the services provided without undue delay.

6.5 The operators are not liable for any damage caused by the Customer’s negligence or failure to follow the therapist’s instructions.

6.6 The client is required to inform the therapist of their medical condition, any contraindications, and other relevant information that may affect the course and results of the therapy.

7. Return Policy

7.1 The customer has the right to file a complaint regarding the services if they are not provided in accordance with the contract or these terms and conditions.

7.2 Complaints must be filed without undue delay after the defects are discovered, either in writing or in person at the provider’s place of business, or by email to the address: “info@enterfyzio.cz“.

7.3 The Provider agrees to resolve the complaint within 30 days of receiving it.

8. Privacy Policy

8.1 The Provider processes customers' personal data in accordance with applicable data protection laws.

8.2 Personal data is processed for the purpose of providing services, issuing documents, and communicating with customers.

8.3 The customer has the right to access, correct, or delete their personal data, or to restrict its processing.

9. Ownership of the Website Design and Logo

9.1 The website design and logo used by the providers are protected by intellectual property law and are the exclusive property of the providers.

9.2 Any unauthorized use, reproduction, distribution, or other handling of the website design, logo, or other elements protected by the providers’ intellectual property rights without the providers’ prior written consent is prohibited.

9.3 All rights to the website design and logo, including copyrights, trademarks, and other similar rights, remain exclusively with the providers.

10. Governing Law

10.1 These Terms and Conditions and any agreements entered into between the providers and customers are governed by the laws of the Czech Republic. Any disputes arising from these Terms and Conditions or such agreements shall be resolved in accordance with the laws of the Czech Republic by the competent courts.

12. Final Provisions

12.1 These Terms and Conditions are valid and effective as of April 2, 2025.

12.2 The Provider reserves the right to amend these Terms and Conditions at any time. The Customer will be notified of any changes to the Terms and Conditions in an appropriate manner.
